Terms of Service & Artwork Purchase Agreement

Welcome to the official digital artist platform of Sethu Eyyal ("Platform"). By accessing this website, registering an account, or purchasing artwork, you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms in their entirety, you must not access or use the Platform.

You must be at least 18 years of age or possess legal parental/guardian consent to enter into commercial transactions on this Platform.

The Platform is provided solely for legitimate art acquisition, commission inquiries, and personal portfolio viewing.

Collectors are responsible for safeguarding account credentials. Any activity conducted under your account is your responsibility.

You agree to notify us immediately of any unauthorized access or security breach.

We make every reasonable effort to display artwork colors, canvas textures, and framing details accurately.

Because monitor color calibrations vary, slight variations between digital screens and the physical original painting or print may occur. Dimensions are stated in standard metric and imperial units.

• Fixed Price Artworks: Displayed in Indian Rupees (INR). Prices do not include applicable local taxes unless explicitly stated.

• Price on Request Artworks: Certain high-value or museum-curated originals do not have automated checkout. Acquisition is arranged via private inquiry and customized agreement.

• Price Integrity: Prices are determined authoritatively by server records at the moment of checkout.

• Original Artworks: Each original oil or acrylic painting is a unique, one-of-a-kind (1-of-1) physical work. Once sold, inventory is exhausted and cannot be replicated.

• Limited Edition Prints: Produced using museum-grade archival pigment inks (Giclée) on 100% cotton rag. Limited prints are numbered sequentially and capped at declared edition sizes.

• An order is confirmed only after successful payment authorization and server-side cryptographic signature verification.

• We reserve the right to decline or cancel any order suspected of fraud, unauthorized bot checkout, or pricing anomalies.

• Domestic orders are dispatched via specialized fine art courier partners with 100% transit insurance.

• Title and risk of loss transfer to the collector upon confirmed delivery by the carrier partner.

Cancellations, transit damage claims, and returns are strictly subject to our published Returns Policy.

Custom commissions and price-on-request acquisitions are governed by specific terms and are non-refundable once production commences.

IMPORTANT INTELLECTUAL PROPERTY NOTICE:

All visual artworks, oil paintings, sketches, digital images, film stills, video documentation, website design, and written texts are the exclusive intellectual property of Sethu Eyyal and protected under the Indian Copyright Act, 1957, and international copyright treaties.

PURCHASE OF A PHYSICAL ARTWORK DOES NOT CONVEY COPYRIGHT.

Acquisition of an original painting or print grants the collector physical ownership of the tangible item for private display. It DOES NOT transfer reproduction rights, commercial exploitation rights, merchandising rights, or digital distribution rights.

Collectors may not reproduce, create derivative works from, or commercially exploit any artwork without prior written license from the artist.

Collectors submitting reference photographs for custom commissions represent and warrant that they possess all necessary rights and permissions to provide such materials.

You grant the artist a limited, non-exclusive license solely to view, reference, and utilize the material for creating the commissioned artwork.

Collector reviews must reflect genuine experiences with purchased artworks. Abusive, defamatory, or unlawful submissions will be rejected during moderation.

These Terms shall be governed by and construed in accordance with the laws of India.
